Application Terms and Conditions (Venues)

“Great Southern Nights” (GSN) is a NSW Government initiative delivered by its tourism and major events agency Destination NSW (ABN 52 890 768 976) (DNSW) in partnership with Australian Recording Industry Association Ltd (ABN 72 002 602 944) (ARIA). The purpose of GSN is to support the recovery of the live music, entertainment and hospitality industries in NSW.

We thank you for your interest in participating in GSN through your submission of an application via this application process. These terms and conditions apply to this application process. Your submission of an application is deemed acceptance of these terms and conditions. If your application is successful, you will be required to enter into a separate agreement with ARIA that will set out the terms of the arrangement between you and ARIA. It will include details of the financial contribution from ARIA and you will also be required to provide certain benefits and perform certain obligations for DNSW.

1. General Terms

Before you start:

  • It is important to note that submitting an application as a part of this application process does not automatically grant the applicant with acceptance to participate in the GSN program. There is a selection process involved and your application will be evaluated as a part of a review process undertaken by ARIA (see Selection Process below).
  • These terms and conditions may be amended from time to time at ARIA’s discretion, so please check these terms before you submit your application.
  • All applicants must be a registered business and hold an ABN or ACN.
  • All applicants must own or operate a venue that has the administrative and technical capabilities and capacity to host live music performances.
  • All applicants are responsible for any costs that may be incurred in preparing and submitting an application in connection with this process.
  • If the successful applicant (as the operator  of the venue for the performance/gig), will be required:
    • to have the requisite public performance licences in place (e.g. a licence from OneMusic Australia) for the performance of music within the venue; and
    • to comply with all applicable and relevant laws including public health orders and liquor licensing.
  • All successful applicants will be required to have appropriate insurance in place (see Insurance below).

2. SELECTION PROCESS

Applications will be assessed and short-listed for inclusion in the GSN program by the GSN Program Manager and curatorial team. Submissions will be reviewed against the selection criteria. If the application is successful, the applicant will be invited to enter into discussions on performance location and venue preference, with the following points of consideration:

  • the GSN Programming team will liaise with performance representatives to engage the most appropriate venue and/or artist for their performance. This would include consideration for metropolitan and regional venues, based on artist and venue availabilities, venue capacities, and genre suitability.
  • In addition to the financial contribution, the applicable GSN participant will be able to enter into direct negotiations with the selected artist on potential venue deals, such as door deals, in order to potentially increase event revenues and satisfy venue costs, while executing an agreement as per standard practice between the two parties.
  • GSN Senior Program Manager is to be advised of all such deals prior to confirmation, with the ability to amend where deemed necessary.
  • The financial contribution provided by ARIA is to be used to include a minimum of 1 x Support Act.
  • The GSN participant may provide suggestions for this support act, with final selection made by the GSN Senior Program Manager and curatorial team.

The GSN participant may also submit a venue themed ‘takeover event ‘as long as it doesn’t diminish being under the banner of a GSN presented event (see Marketing and Promotionsbelow).

3. Marketing and Promotions

  • GSN participants will be required to promote their performance/gig using the “Great Southern Nights” branding. Successful applicants will be provided with a toolkit from ARIA to assist with promoting the performance/gig.
  • GSN participants are not permitted to announce their involvement with GSN until ARIA advises that this can occur. GSN participants agree to work with ARIA in relation to promotion and publicity opportunities.
  • All GSN participants are required to provide ‘pre-approved’ high-resolution digital head shots or promotional images of the artist and if available, up to one minute of  broadcast-quality video footage of artists (i.e. high definition, jpeg, 300 DPI printed at A3) free of charge, royalty-free for use worldwide by ARIA and DNSW. Pre-approved means that all relevant and necessary parties have approved use of the images/footage.

4. Sponsorships

GSN participants are not permitted to have any sponsorships or third party promotions associated with the performance/gig. This includes running any competitions. If you wish to undertake any of these activities, you will be required to obtain approval from ARIA and DNSW and certain conditions may apply.

5. GSN LOGO PRESENCE

DNSW and ARIA will require the inclusion of their logos in connection with the performance/gig. This may include the display of their logos on promotional materials, posters, certain signage at the performance/gig. It may also include printing the designated DNSW logos on the tickets for the performance/gig.

6. MEDIA ACCREDITATION

GSN participants will need to provide media accreditation for ARIA and/or DNSW photographers at the performance.

7. TICKET SALES

  • GSN participants will be responsible for the ticket sales at their performance/gig. ARIA and DNSW do not receive any ticket revenue or proceeds from the sales of any tickets.
  • As a part of your ticket sales process, you will be required to submit to ARIA updates on registrations and ticket numbers for your event on reasonable request by ARIA. You will also be required to capture and retain ticket purchaser and attendee information. This is important for COVID-19 contact tracing purposes, and also for the DNSW research requirements (see Research below).

8. COMPLIMENTARY TICKETS

GSN participants will be required to provide a certain amount of complimentary tickets for their event to ARIA for provision to GSN stakeholders such as DNSW.

9. RESEARCH

  • As a GSN participant, you may be required to grant permission for DNSW to have survey teams on and around the venue to conduct research and hand out DNSW materials/flyers where it is reasonable and appropriate. The survey teams will be at DNSW’s cost and will be subject to venue approval and requirements.
  • After your performance, you will also be required to send a DNSW survey to ticket purchasers via email. DNSW will be responsible for any costs involved with this survey.
  • GSN participants will be required to provide event data to ARIA for DNSW research purposes. A template will be provided to you. The data required includes expenditure, attendance numbers, attendee postcodes, attendee/staff/performer postcode data and ticketing reports.

10. Insurance

All successful applicants will be required to take out and maintain on its behalf (and in respect of the performance/gig), the following insurance:

  1. public liability insurance covering claims, liability to ARIA and DNSW, and liabilities to third-parties in respect of destruction of, loss of or damage to real or personal property and injury to, or death of, persons, arising out of or in connection with the conduct of the performance for a minimum amount of $20 million per occurrence; and
  2. a policy of workers’ compensation insurance.

Successful applicants will be required to provide a certificate of currency for this insurance when entering into the agreement with ARIA, so please make sure you have a copy in your records. You will also need to ensure that DNSW and ARIA are each noted as an interested party.

11. TV BROADCASTS AND STREAMING YOUR GIG

If you are planning to broadcast or live stream your gig, then you will need to accommodate various content integration requirements from DNSW. You will need to consult with ARIA before any broadcast or live stream occurs to ensure these requirements are met.

12. Privacy

By submitting an application, you consent to, and grant permission for ARIA to share your application with DNSW and third-parties for the purposes of review and assessment. By submitting an application you consent to this disclosure. Please review the Privacy Policy for further details.
